Governments can also set price caps for goods and services if they believe that manufacturers are not benefiting from the way prices for goods and services are set in the open market. This allows companies to remain competitive and ensure that they are profitable. (1) 10 U.S.C. 983, Higher Education Institutions That Impede Access to ROTC or Military Recruitment on Campus: Denial of Grants and Contracts from the Department of Defense, the Department of Education, and Certain Other Departments and Agencies (see 9.110). 13.303-1 General. (a) A master purchase agreement (EPS) is a simplified method of meeting the expected recurring demand for supplies or services by establishing „expense accounts” with qualified sources of supply (see subsection 16.7 for additional coverage of the agreements). (b) GAP should be set up for use by an agency responsible for providing its own operations or other offices, facilities, projects or functions. These organizations may be, for example, organized supply points, independent or separate parts of the field, or positions or activities of a single person. (c) the use of BPA does not relieve an agency of responsibility for maintaining commitments and expenditures within available resources; 13.303-2 Establishment of GAP.

(a) These are the circumstances in which procuring entities may determine THE BPA: (1) There are a large number of items in a broad category of supplies or services that are generally purchased, but the exact items, quantities and delivery requirements are not known in advance and can vary considerably. (2) It is necessary to provide commercial sources of supply for one or more offices or projects in a given territory which do not have or require a different purchasing power. (3) The application of this procedure would avoid the drafting of numerous orders. 4. There shall be no supply or service contract for the same supply or service to be used by the award of the contract. (b) After it has been established that AN EPS would be beneficial, contract agents must: (1) set parameters to limit purchases to individual items, groups or categories of goods or to allow the supplier to provide unlimited supplies or services; and (2) Consider suppliers whose past performance has been shown to be reliable, who offer high-quality deliveries or services at consistently lower prices, and who have made numerous purchases at or below the simplified acquisition threshold. (c) the BPA may be established with (1) more than one supplier of supplies or services of the same type in order to ensure maximum competition; (2) a single undertaking from which a large number of individual purchases are likely to be made at a level equal to or below the simplified acquisition threshold in a given period; or (3) Contractor of the Federal Schedule to Procurement, unless to do so contrary to the terms of the applicable Schedule Agreement. (d) BPA should be established without a purchase requisition and only after contacting suppliers in order to make the necessary arrangements to: (1) ensure maximum discounts; (2) Documentation of individual purchase transactions; (3) Periodic regulations; and (4) the inclusion of other necessary details. 13.303-3 Preparation of EPS. Create BPA on the forms specified in 13,307.

Do not provide accounting and appropriation data (see 13.303-5(e)(4)). (a) The following conditions are mandatory: (1) Description of the Agreement. A statement generally describing that the contractor will provide supplies or services at the request of the contract agent (or agent of the contracting entity) for a specified period of time and, where applicable, up to a certain total amount. (2) Scope of the obligation. A statement that the government is only required to make authorized purchases to the extent that they were actually made under BPA. (3) Purchase Restriction. A statement showing the dollar limit for each individual purchase under THE BPA (see 13-303-5(b)). (4) Persons who have the right to purchase under BPA.

A statement that a list of persons authorized to purchase under the BPA, identified either by the job title or by the name of the individual, the organizational component and the dollar limit per purchase for each job title or person, will be provided to the supplier by the counterparty. (5) Delivery notes. A requirement that all shipments under the Agreement, with the exception of those for newspapers, magazines or other magazines, must be accompanied by delivery notes or vouchers containing the following minimum information: (i) Supplier Name. (ii) BPA number. (iii) Date of purchase. (iv) Purchase number. (v) individual proof of the supplies or services supplied. (vi) Quantity, unit price and renewal of each item, less applicable discounts (unit prices and renewals do not need to be indicated if they are incompatible with the use of automated systems, provided that the invoice is broken down to display this information). (vii) Date of delivery or shipment. (6) Invoices.

One of the following declarations must be attached (except that the declaration referred to in paragraph (a)(6)(iii) of this subdivision shall not be used where the accumulation of individual invoices by the government significantly increases the administrative costs of this method of purchase): (i) A summary invoice must be submitted at least once a month or after the expiry of this APP; whichever comes first, for all deliveries made during a billing period, indicating the delivery notes they contain, indicating their total monetary value and supporting copies of the delivery notes. (ii) For all deliveries made during a billing period for which payment has not been received, a itemized invoice must be submitted at least once a month or after the expiration of this BPA, whichever comes first. These invoices do not have to be justified by copies of delivery notes. (iii) where the settlement procedure provides for an individual invoice for each supply, those invoices shall be cumulated provided that: (a) a consolidated payment is made for each period indicated; and (B) The period for any discount begins on the end date of the billing period or on the date of receipt of invoices for all deliveries accepted during the billing period, whichever is later. (iv) A subscription invoice or other charges for newspapers, magazines or other magazines must indicate the start and end dates and indicate that the ordered subscriptions have entered into force or are effective upon receipt of payment. (b) Where the rapid payment procedure is used, the requirements referred to in point 13.403 shall be indicated. 13.303-4 Clauses. (a) The procuring entity shall include in each BPA such terms as are prescribed elsewhere in this Part that are necessary or applicable to the BPA concerned.
