Legal English Gazeta

The verdict against Novaya Gazeta is yet another blow to the independence of the Russian media, whose activities have been hampered by legal restrictions and increased state controls imposed following the Russian Federation`s attack on Ukraine. Gazeta Lwowska was originally a press organ of the Austrian authorities in Galicia and was limited to the publication of legal opinions. In 1873, when Władysław Łoziński became its editor, she began to insert local and world news, and since 1874 she published a monthly supplement Przewodnik Naukowy i Literacki (Scientific and Literary Guide), devoted to history, literature, geography, economics and ethnography. Among the writers who collaborated with Gazeta Lwowska were Adam Krechowiecki, Ludwik Kubala, Karol Szajnocha, Józef Szujski, Alfred Wysocki, Walery Łoziński. We have repeatedly expressed our concern about the Aliens Act and its deterrent effect on the free exercise of civil and political rights. We note that it has often been invoked in a manner inconsistent with human rights law to restrict or deny the exercise of the rights to freedom of expression, peaceful assembly and association, among others. The front page of Russia`s famed Novaya Gazeta news agency this week offered a grim assessment of Russia`s war in Ukraine. Ballet dancers can be seen in front of a cloud of mushrooms, and the words read: „A copy of Novaya, created in accordance with all the rules of the amended Russian Criminal Code.” The coverage refers to an escalation of nuclear tensions, a performance of Swan Lake, which was streamed on Russian state television during a KGB coup attempt in 1991, and the recently amended media law, which provides for heavy penalties for „fake news” about the war in Ukraine. Pressure on independent Russian and international media has forced several of them to close or relocate their activities abroad. Journalists are instructed to use only official statements and avoid the words „attack” and „invasion”. Moscow-based Novaya Gazeta, run by Nobel laureate Dmitry Muratov, received a warning from media regulator Roskomnadzor in the early days of the Russian invasion. We are deeply concerned by the Moscow court`s decision to revoke the license of Novaya Gazeta, a respected national newspaper whose editor-in-chief was awarded the 2021 Nobel Peace Prize. The court found that the newspaper had repeatedly violated the legal requirements of foreign agents. Since then, the regulator has ordered the blocking of several websites, including the Russian version of Voice of America. Novaya Gazeta journalists are used to working under pressure. Media workers have been threatened, harassed and even killed because of their reporting. Now they are working to survive a repressive environment, says Nadezhda Prusenkova. In an interview with VOA`s Russian service, Novaya Gazeta reporter spoke about the pressure on the country`s media and efforts to maintain the flow of information. The interview has been translated and edited for length and clarity.

What is the state of mind of the editorial staff of Novaya Gazeta? Prusenkova: I have been working at Novaya Gazeta for quite a long time and this is probably the most difficult period in the history of Novaya Gazeta. The last edition we published was the most difficult, both technically and morally to compile. How do you manage to keep working? Prusenkova: When the fake news law came into force, nearly 30 media outlets were blocked, shut down or destroyed. Journalism has been lost in Russia – it simply no longer exists. At least one independent journalism. We are still here. We are trying to do our job. We understand that our voice – even if it cannot call black „black” and white „white” – has also been silenced, because when we call a spade a spade, we are closed and cease to exist.

We asked our readers: What should we do if we can`t call special surgery by its proper name? What if we can`t write about what`s really going on and just type press releases from the Department of Defense — something we won`t do because it violates ethics and common sense and all the laws of being? And our readers supported us. They said they didn`t care what we called the current situation: „We know what you mean. Stay as long as you can. That`s the only reason we didn`t close or leave ourselves. Media outlets such as Ekho Moskvy have been blocked and liquidated. Do you think Muratov`s awarding of the Nobel Peace Prize helped keep Novaya Gazeta open? Prussenkova: I`ll be honest, I don`t know. Based on the terrible logic by which things are happening now, the price would be an argument to shut us down. Like everyone else, we received a handful of warnings from the [media regulator]. Like everyone else, we received a letter from the Ministry of Defense stating that the media – and Novaya Gazeta in particular – publish unverified information and fake news. That was before the law came into force.
